President Bush's ongoing efforts at reforming the nation's tort system are an embarrassment to himself and his administration. While placing caps on medical malpractice jury awards may result in a temporary abatement of malpractice rate increases, and possibly even a short term reduction in rates charged to doctors, once the issue is behind the President and the attention span of the American people, insurance rates will once again rise like the Phoenix.

For anyone who has had the unfortunate experience of being involved in a car accident that was entirely the result of another driver's negligence, the process of obtaining payment for the damage to your car can be more painful than a busted rib. While the law generally seeks to fully compensate the innocent driver for the losses caused by the responsible party, the fact is, insurance companies' don't quite see it that way. In Massachusetts, and in most other states for that matter, when a party suffers damage to his or her vehicle as a result of the negligence of a second driver, the insurance company insuring the second driver, is responsible for compensating the innocent party for the fair value of the damage caused.
